Prosecutors at the International Criminal Court (ICC) are investigating reports of the death of Mohammed Deif, the senior Hamas military leader, and have indicated they will drop their case against him if confirmed, Reuters reported. Deif, 58, is suspected of being a key figure behind the October 7, 2023, assault on southern Israel, which sparked the ongoing Gaza war, and has since led Hamas’s military efforts in Gaza.
Israel claims Deif was killed in an airstrike on the southern Gaza city of Khan Younis on July 13, but Hamas has neither confirmed nor denied the report. According to legal documents filed under seal on August 2 and revealed on Tuesday, “The prosecution will withdraw its (arrest warrant) application against Deif if sufficient and reliable information confirms his death.”
This follows the ICC’s recent decision to terminate proceedings against Hamas leader Ismail Haniyeh, who was reportedly assassinated in Iran on July 31.

The ICC is currently considering arrest warrant requests for both Israeli and Hamas leaders, including Israeli Prime Minister Benjamin Netanyahu and Defense Minister Yoav Gallant, as well as Yahya Sinwar, the current head of Hamas. These requests were made by ICC chief prosecutor Karim Khan in May, in relation to alleged war crimes and crimes against humanity during the October 7 attacks on Israel.
