US TO DEFEND ISRAEL IN ICJ GAZA GENOCIDE CASE AGAINST SOUTH AFRICA

The United States has formally intervened in the genocide case against Israel at the International Court of Justice (ICJ), marking a significant development in the legal dispute brought by South Africa over Israel’s military campaign in Gaza.

The move places Washington directly into one of the most consequential international legal proceedings related to the Gaza war and underscores the geopolitical stakes surrounding the case at the United Nations’ highest judicial body.

The ICJ confirmed that Washington submitted a “declaration of intervention”, a legal procedure allowing states to present arguments on the interpretation of international treaties relevant to a case.

The United States stated in its filing that it strongly rejects the allegations raised against Israel.

“The United States affirms, in the strongest terms possible, that the allegations of ‘genocide’ against Israel are false,” Washington said in its submission to the court.

The filing also criticized the broader legal campaign accusing Israel of genocide. According to the U.S. statement, the claims are part of a longstanding effort “to level false charges of ‘genocide’ against Israel” that has persisted for decades.

The case before the ICJ originates from December 2023, when South Africa filed proceedings arguing that Israel’s military campaign in Gaza violated the 1948 United Nations Genocide Convention. The treaty obligates states to prevent acts committed with the intent to destroy a national, ethnic, racial or religious group.

More than a dozen countries have since applied to intervene in the case, indicating their intention to submit legal views when the hearings begin. Several governments have signaled support for South Africa’s position, raising the prospect of a wide-ranging international legal confrontation at the Peace Palace in The Hague, where the ICJ is based.

Proceedings at the court can extend over several years before a final judgment is delivered. In the meantime, judges have issued interim rulings intended to address urgent humanitarian concerns connected to the conflict.

The court has already issued emergency measures in the case, ordering Israel to take steps to prevent acts that could constitute genocide and to allow humanitarian aid into Gaza.

In a separate decision, judges also ruled that Israel must ensure Palestinians receive the “basic needs” necessary for survival.

While ICJ rulings are considered legally binding, the court does not have enforcement powers and relies on states or international institutions to implement its decisions.

The legal case has become one of the most closely watched proceedings in international law, with governments and civil society organizations debating the interpretation and application of the Genocide Convention.
