AUSTRALIA TO COMPENSATE FAMILIES OF AFGHAN WAR CRIME VICTIMS

The Australian Defence Department announced a compensation plan for families of victims who were unlawfully killed or abused by Australian special forces in Afghanistan.

Over the course of 20 years, more than 39,000 Australian soldiers served in Afghanistan, with 400 soldiers participating in peacekeeping efforts alongside the United States and other allies before withdrawing in 2021.

An investigation found that Australian soldiers committed war crimes, including murder and abuse of many Afghans. Incidents included shooting prisoners and planting weapons, radios, and grenades next to Afghan civilians to suggest they were “legitimate targets.”

There were also issues with a lack of mentorship among troops and a “warrior culture” focused on status and power rather than exemplary soldier conduct.

The 2020 Brereton report, led by Major General Brereton, alleged that 25 Australian soldiers were involved in murdering 39 Afghans and recommended criminal investigations.

However, before these issues go to court, the Australian Defence Force Inspector General believes the government should compensate the victims’ families.

A defence department spokesperson stated that the government is committed to implementing the report’s findings to the “fullest possible extent” – including compensation.

The compensation regulations will involve a new Afghanistan Inquiry Compensation Advocate who will assess claims referred by the Chief of the Defence Force (CDF), Admiral David Johnston.

Referrals will be based on criteria such as the claimant being related to someone “reasonably likely” to have been abused or had property damaged, or being a family member of someone unjustly murdered.

After reviewing the claim, the Advocate will report to Johnston with their recommendation, and Johnston will determine the outcome.

In addition to compensation, the Defence Force is working on reforming army culture, ensuring command accountability, and deciding whether to strip awards and honors from those involved.
